Broccoli vs. Health Insurance

You can?t eat broccoli without paying for it. You can get health insurance without paying for it because hospitals are obligated to treat you if you turn up at the ER door. This means society is providing health insurance for free to some people. They are being subsidized by the people who pay for health insurance. There is no such issue with broccoli. Note I am using the phrase health insurance not health care as some of the justices tried to make a distinction between the two.

We can turn heath insurance into broccoli by denying care at the ER door to the uninsured. This is feasible as healthcare services are excludable. Whether society wants to do that are not is a political judgement. Hence, elections are the right mechanism to determine this issue.

Broccoli vs. Wheat

Via the New Yorker,

the Commerce Clause of Article I, Section 8 of the Constitution, [gives] Congress the power

To regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes.

How has this been interpreted? Again, via the New Yorker:

In the famous 1942 case of?Wickard v. Filburn, the Court said that the federal government?s authority extends to any activity that ?exerts a substantial economic effect? on commerce crossing state lines.

The case involved Roscoe Filburn, an Ohio farmer who wanted to grow more wheat than he had been allotted under quotas introduced during the Great Depression to drive up prices. In deciding against Filburn and in favor of the Department of Agriculture, the justices pointed out that the actions of individual wheat farmers, taken together, affect the price of wheat across many states. That is what gives the federal government the power to limit their actions.

This argument can be made for any good, private or public. Hence, the externality argument made above is not necessary under this precedent. Also, Justice Scalia, Roberts etc can be forced to buy broccoli by law.

What is then the limiting principle? The commerce clause has no limiting principle, according to me, a non-lawyer. The limiting principle is the?imposed by politics:?any politician who seeks to regulate the broccoli market must run for election. This politician will reach the limit of his political career.

'Titanic' Theme Song Makes Kate Winslet 'Feel Like Throwing Up'

'Bless you, Celine, but it does rather haunt me,' the actress admits to MTV News of 'My Heart Will Go On.'

"Like throwing up." That's how Kate Winslet feels when she hears Celine Dion's "My Heart Will Go On," the once-inescapable theme to "Titanic."

"No, I shouldn't say that," Winslet added, thinking through her response before coming to this conclusion: "No, actually, I do feel like throwing up."

Since its release in 1997, the film has stuck with Winslet wherever she goes. It was the movie that helped her sky-rocket to the A-list, after all, and no one is likely to forget Dion's iconic song from "Titanic," set to be re-released in 3-D on April 4.

"I wish I could say, 'Oh listen, everybody! It's the Celine Dion song!' But I don't," Winslet admitted. "I just have to sit there, you know, kind of straight-faced with a massive internal eye roll."

Winslet went on to explain that every time she walks into a bar or a restaurant with a pianist, they never miss an opportunity to start playing the notes. "It's thrilling for people to surprise me with the Celine Dion song," she laughed.

But they not only play the tune for her, they also encourage the Oscar winner to sing it herself. "I did a talk show recently in Italy and they actually had a live pianist who started gently playing the theme song. I was not even gently, rather severely, urged to go and sing it as though I had in fact sung it myself in the first place. It was like, 'No! I'm not going to do that.' They're like, 'Oh no, come on it will be funny.' No, it won't be funny. At all. And I'm not going to."

Unfortunately for the actress, it's not just the theme song that haunts her. Whenever she boards a boat, she's the butt of jokes.

"Honestly, I actually now get onto boats and say, 'No jokes, OK? No jokes. Can we just move on from that? And if you have any jokes, let's just get them out of the way right now. Thank you. Anyone? Jokes, jokes? OK, moving on.' And then they still tell jokes," Winslet said. The most common joke is asking her to head to the front of the boat with them to reenact the iconic scene between hers and Leonardo DiCaprio's characters on the rail. To that she replies, "Oh, yeah! Oh, that one! Oh, don't worry, it's my party piece. Sure, come on up, bring your granny."

But Winslet is actually an amazing sport about the jokes. She understands how deeply the film touched its audience. And now that it will be on the big screen again, it can reach a whole new generation — including her children who will see it for the very first time.

"What's negative about it? Really, nothing at all," she said of the 3-D treatment. "It's very different and much more present. It's bigger — if you can believe that — but it is and you really do feel like you're in it."

Audiences will be able to relive the tragic love story — or experience for the first time — when "Titanic" it hits theaters in 3-D on April 4.

The greatest animated film ever made and one of the screen's great musicals hardly needs this (3D) sort of sprucing up.

What you gain in an extra, faked dimension you lose in lively, genuine beauty.

The set pieces are narcotically pleasing, especially the Busby Berkeley-style dancing-kitchenware spectacular, "Be Our Guest," and the romantic ballroom centerpiece that brings Beauty and her Beast together.

The 3-D pops out to enhance the drama or energy of scenes in which settings are large and integral to the action.

Some youthful memories are better not revisited, but this definitely isn't one of them. Sometimes you can go home again.

It is a surprise, in a time of sequels and retreads, that the new film is so fresh and altogether triumphant in its own right.

I admit it: I wrote this more than 20 years ago. But, like " Beauty and the Beast" itself, I think it stands the test of time.

Disney, please understand ... what people are actually showing up for ... they just want to see classic Disney on the big screen. The 3D is incidental.

Disney's gorgeous 1991 animated version of the classic fairy tale "Beauty and the Beast" gets the same 3D treatment that was recently given to "The Lion King."

Watching this in a theater definitely makes it feel less like a "cartoon" and more like a significant film. Cogsworth poking Le Fou in the butt with a sword aside.

One of the brightest jewels in Disney's crown, Beauty and the Beast's 3D reissue takes nothing away and makes the film's brilliance even easier to appreciate; the movie is more beautiful and timeless than it ever was.

Beauty and the Beast is just as enchanting 20 years after its initial release.

The apex of an art form, a justly celebrated classic, and the best animated movie of any sort ever put on screen at any time.

The lines have begun to show in Belle's tale, which remains enjoyable but feels more like a quaint artifact than the masterpiece it once was declared to be.

Both TANGLED EVER AFTER and BEAUTY AND THE BEAST are sure to enthrall audiences everywhere, even if the 3D doesn't really add much of anything to this animated classic.

A serviceable version of a classic fairy tale minus that crucial touch of magic.

And it is a joy to revisit the timeless pleasures of traditional Disney storytelling, with no attempts to add sizzle from celebrity voice talent or radio-friendly pop songs.

3D doesn't downplay the inherent artistry of the effort, but it doesn't enhance anything outside of ticket prices.

Beauty and the Beast looks beautiful and is sure to entertain, but this experience is superfluous at best-it was already a three-dimensional story long before these new technics.

Better remembered than seen, Beauty and the Beast has been treated unkindly not just by the years that have passed since it was released to enormous acclaim in 1991, but by a faddish 3D conversion.

This ancient whale enjoyed tropical waters

An ancient beast related to today's Arctic-loving beluga whales and narwhals seemed to prefer toasty, tropical waters.

Called Bohaskaia monodontoides, the new species of toothed whale lived some 3 million to 4 million years ago during the Pliocene in warm water. Researchers aren't sure why modern belugas have left these tropical destinations and strayed pole-ward, where life would seem to be more difficult.

The fossil had been sitting in the collections of the Smithsonian's National Museum of Natural History since its discovery in a mine near Hampton, Va., in 1969. The nearly complete skull represents the only fossilized remains known of the new species. Before it was closely examined, the skull's discoverers loosely identified it as a beluga whale and left it in storage.

In 2010, Jorge Velez-Juarbe, Smithsonian pre-doctoral fellow from Howard University, finally took a close look at the skull. He compared it with the skulls of closely related toothed whales, such as modern Arctic belugas and narwhals (also called unicorns of the sea for their twisted horn). While the skull shared many features, particularly in the face and snout, with modern toothed whales, the researchers say there are enough unique features to merit its placement in a new genus and species.

"We realized this skull was not something assignable to a beluga, and when we sat down, comparing the fossil side by side with the actual skulls of belugas and narwhals, we found it was a very different animal," study researcher Nicholas Pyenson, of the Smithsonian's National Museum of Natural History, said in a statement.

This and a second temperate example of a beluga-related whale indicate that the love of frosty water developed recently in these whales.

"The fact is that living belugas and narwhals are found only in the Arctic and sub-Arctic, yet the early fossil record of the monodontids extends well into temperate and tropical regions," Pyenson said. "For evidence of how and when the Arctic adaptations of belugas and narwhals arose we will have to look more recently in time."

Pope heads to Cuba, seeking change and faith revival

SANTIAGO DE CUBA (Reuters) - Pope Benedict arrives in Cuba on Monday on a three-day visit that has fueled aspirations for deeper economic and political change on the communist-run island and which the Roman Catholic Church hopes will spark a faith revival.

Visiting 14 years after Pope John Paul II's landmark trip to Cuba, and arriving after a stop in Mexico, Benedict will pay homage to the island's patron saint, the diminutive doll-like figurine the Virgin of Charity of El Cobre, and say Masses in the eastern city of Santiago de Cuba and in Havana.

He comes to Cuba at a time when church-state relations have warmed after decades of hostility that followed the island's 1959 revolution.

President Raul Castro has used the Church as an interlocutor on issues such as political prisoners and dissidents, seeking support for his reforms to Cuba's rickety Soviet-style economy that partly involve slashing a million government jobs.

The Church is the largest and most socially influential institution outside of the government in Cuba.

Castro will meet Benedict at the airport in Santiago de Cuba, which is Cuba's second biggest city, then hold official talks with him on Tuesday in Havana.

It was not yet known if Benedict, 84, would meet former Cuban leader Fidel Castro, who is 85 and Raul's older brother, or Venezuelan President Hugo Chavez, 57, who arrived in the Cuban capital over the weekend for cancer treatment.

Chavez has become more publicly religious since he was operated on for cancer last summer in Cuba. Unconfirmed reports out of Venezuela said the pope would see him in Havana.

In Mexico, Benedict denounced drug violence and corruption, while in Cuba he was expected to build on improved relations with the state to get a bigger role for the Church by expanding its social programs and education courses.

But he fired an unexpected salvo on Friday when he told reporters that communism on the Caribbean island had failed and a new economic model was needed.

While even non-Catholic Cubans are eagerly awaiting his visit, not everyone agreed with his views on communism.

"All Cubans would like the pope's visit to have repercussions that help end the embargo, but we don't need a new system," said Sergio Teyes, 40, sitting next to the frayed 1950 Chevrolet Deluxe classic car he uses to drive tourists around town, its bumpers and trim dented and blue paint flaking off.

"The economy has been improving, growing, education and healthcare is paid for," he added. "Marxism will always be the idea, but with improvements. One thing we could do with are better salaries."

The Communist Party ended its ban on religious believers in 1991, but Cubans generally view John Paul's visit as the pivotal moment that led to improved Church-state relations.

Expectations are more muted for Benedict's visit, which coincides with the 400th anniversary of the discovery of the Virgin figurine, and was inspired by a stirring of faith the Church saw in hundreds of thousands of people who thronged to a procession of a replica around the island last year.

The Virgin is an important figure for both the Church and Santeria, the Afro-Cuban religion that is a legacy of Cuba's slavery era and knows her as Ochun, the goddess of love.

The pontiff will lead a Mass in honor of the Virgin in Santiago de Cuba on Monday, and then visit the sanctuary where it is enshrined in the mountainside town of El Cobre, 12 miles outside the city, on Tuesday.

But Church officials say his schedule has not allowed for meetings with dissidents, who say Castro's government flouts human rights and suppresses their voices.

The dissident movement Damas de Blanco, or Ladies in White, a group of Catholic women that campaigns for the release of political prisoners, said it had been told by Cuban authorities to keep clear of the pope's Santiago Mass.

"They are going to present the pope with a facade, not with the true Cuba," said Ana Celia Rodriguez, a 42-year-old mother of three who is planning to try to attend Monday's Mass anyway.

"I really don't expect much change from the pope's visit. He'll see a Cuba that doesn't exist. My message for the pope is that he ought to see how things really are."

More than 70 of the group were detained briefly last week, fueling expectations that the government, which views opponents as mercenaries of the United States, might clamp down to prevent public demonstrations during the pope's stay.

Recently, my eager for cooking is getting low because I want to go out to eat something different. ? These days, I'm tired of spending energy, time, and money on a special meal for just two persons. ?When my husband nonchalantly asked me going out to eat, I instantly agreed. ?
A few days ago, one restaurant was chose by my quick sense. ?Basically,?I have a vague memory related to English terms. ?However, surprisingly I have a good memory related to good restaurants. ?What a great habit! ?:-(
We visited?Avila's El Ranchito Mexican restaurant that my husband's friend recommended before.
Also, I recently watched Mexican food, Seven Seas Soup in Food Channel. ? The soup looked very tasty. I had wondered it.
?My husband and I ordered the soup and chicken salad. ?First, we were served one basket of full with nacho chips and a small glass bowl of salsa. ?Soon, we added guacamole and Margarita. ? I love eating nacho chips with great concoction of spicy salsa and guacamole. ?I love feeling a bit tipsy from drinking Margarita.
20 minutes later,our orders came everything together. ? Suddenly, my table was covered with colorful foods, reddish soup, greenish salad, and my favorite drink, yellowish Margarita! ?That soup was delicious. ?The salad wasn't special, but good. ? Waiters and waitresses in Mexican style costumes, the unique, decorative stuff looked?I was in Mexico.?It was a good place to eat Mexican style food near my home.

SALT LAKE CITY (AP) ? A 101-year-old Utah woman who ushered in her birthday with a tandem paraglide ride last year soared into the record books Tuesday.

Great-great grandmother Mary Hardison, of Ogden, has been officially recognized as the "Oldest Female to Paraglide Tandem" by Guinness World Records. She has supplanted a 100-year-old woman from Cyprus who took her flight in 2007.

Hardison flew with an instructor on Sept. 1, 2011, while four generations of her family watched and cheered. The flight went smoothly and even included a few tricks that Hardison encouraged.

Hardison said she wanted to paraglide because her 75-year-old son began doing it as a hobby.

"I didn't want him to get too far ahead of me, so I decided that I'd go too," she said Tuesday.

Fear never entered the equation for Hardison, who previously rode all of the adult rides at Disneyland to celebrate her 90th birthday.

Hardison said she was shocked to learn her flight had become a world record.

"To me, I was just going on a little ride," she said. "I had no idea I'd break a record."

Hardison said her active lifestyle has already inspired others her age to pursue similar adventures.

"Some people have said, 'Well, if you can do that at your age then there's no need for me to just sit around,'" she said. "My desire is for the elderly to keep on going. Do things as long as you are physically able. Be positive. Friends don't like a grumpy person."

When Hardison decided to take the birthday leap, family members were concerned for her safety. After all, it was her first flight and she was the oldest customer the paragliding company had ever taken into the air.

"My first reaction was she was nuts," said daughter-in-law Bonnie Hardison. "But everyone is just so excited and thinks this record is great."

As for any future flights, Mary Hardison, who spends her days quilting for charities, is just playing it by ear.

"If the notion strikes, I'll go again," she said.

Our first weekend with the newest Apple device.

We?ve had a good couple of days playing with the new iPad from Apple and even though our review seems to match a lot of the other ones we?re going to tell you what we thought anyways because you want a Hong Kong perspective, right?

We gave you some of our immediate reactions in Friday?s post, so we?re going to expand on it here:

Retina Display

From the very first time you turn on the new iPad you will notice the amazing clarity in the screen. In comparison, looking at the iPad 2 is like looking at a movie on VCD and one on Blu-ray. Once you get used to the new retina display you can never look at the iPad 2 again. It?s amazingly clear ? your email, webpages and photos all POP out like crazy. Probably the same feeling you had when you first saw a Blu-ray movie too.

The problem with this is that it?s too hard to show you images of what it looks like. Our camera cannot capture the difference either ? you just have to see it to believe it. You can click here to see a lock screen we are using of a HD image of the Avengers movie poster ? it clocks in a 6MB for the 2048 x 1536 pixel screen capture ? it?s so clear you can count all the hair in Tony Stark?s beard.

The 5-Megapixel Camera

3 Noticeable Things When Comparing iPads

So while there is a lot to sing about with the new iPad; there are a few things that really stand out that you should look out for.

You?ll notice right off the bat it?s a bit heavier than the iPad 2 (still lighter than the iPad 1) it may be a small thing to the men but might sway women from the upgrade. Obviously it needed to put on a little bit of weight to support the new retina display screen and the bigger battery to power it so the added heft is definitely in there for a reason.

Because the battery is bigger, powering a more powerful screen and processor it tends to take longer to recharge than the iPad 2 and when used for as much as we have been using it over the past 2 days ? it gets a bit warm.

These things are not at all noticeable in the iPad 2 ? so to have 3 things added to a next-generation product, it might seem a bit strange to Apple fans that usually see things get better and smaller with each new iteration.

Odds and Ends

Some things we want to point out, especially if you are reading this to find out if you want to upgrade from your iPad 2 or not:

• All your iPad 2 accessories will work for the new iPad ? meaning the dock connectors, the smart covers and things like that. Complete covers (those with front and back attachments) may not due to the minimal added thickness.
• FaceTime camera on the front of the iPad is the same as the iPad 2 ? so no HD FaceTime video calls yet.
• Apple is calling this 10 hours of batter life, the iPad 2 had 11 easily. We?ve noticed power drain faster in the new iPad than the iPad 2 with use of surfing the web, playing games and watching videos.
• The biggest concern we have at this early stage is that a lot of the apps you use have yet to be upgraded to the new retina display resolution ? meaning you won?t get that crisp line in a lot of the apps you love to use.

  OK, the main ones are already covered: Safari, Facebook, Twitter, Evernote, Kindle, Flipboard, Pulse ? but the magazines that we subscribe to like GQ, Fast Company and even Engadget?s free Distro are all still low-res because they don?t use text display but bitmap graphics giving letters a jagged edge which is really annoying especially when you jump from iBooks to a magazine. Of course this is a moot point when they all upgrade and we expect this weekend many companies are working overtime to upgrade their apps.

Should you buy the new iPad?

It?s essentially a similar upgrade from iPhone 4 to 4S, lots of extra benefits but not necessarily needed for an upgrade if you aren?t spending lots of time on your iPad. On the other hand if this is your laptop replacement or you use your iPad to consume books, blogs, videos and games as much as we do then its a must to upgrade to the new iPad ? your eyes will thank you (and maybe your biceps a bit.)

The new iPad is available now from Apple and Authorized resellers around Hong Kong in 16GB, 32GB and 64GB WiFi models. The 4G LTE models have been delayed into the Hong Kong market due to regulatory issues and contending with HK?s different 4G LTE bands. Apple has given us no time indication on this, so it could be as early as next week or as far off as just before the next iPad launch.

Frease's 25 points lift Xavier over Lehigh 70-58

GREENSBORO, N.C. (AP) ? Xavier is making a habit of reaching the round of 16.

Senior center Kenny Frease scored a career-high 25 points to go with 12 rebounds, and the Musketeers knocked off upset-minded Lehigh 70-58 Sunday night to advance to the regional semifinals of the NCAA tournament for the fourth time in five years.

Xavier was ranked as high as eighth in the country earlier this season, but a midseason bench-clearing brawl that resulted in player suspensions seemed to turn the season on a sour note. They lost their edge and had to battle to make the tournament.

But they seem to have rekindled their momentum.

"We ultimately knew we had talent, but for whatever reason things just weren't clicking," Frease said. "We're coming together at the right time. It feels real good to get back to the Sweet 16."

Lehigh, which stunned No. 2 seed Duke on Friday, was looking to become the first 15 seed to make it to the tournament's second weekend.

But the 7-foot Frease stood in the way.

He dominated in the paint, hitting 11 of 13 shots, and Tu Holloway was his normal productive self with 21 points as 10th-seeded Xavier (22-12) moved on to play No. 3 seed Baylor on Friday in the South Regional at Atlanta.

"Lehigh is a very good team, but they're also small," said Xavier coach Chris Mack. "I'm sure they don't face the type of size that Kenny presents. We just wanted to be able to get the ball to Kenny, and fortunately he was able to finish."

Frease was quick to turn the praise to his teammates after what Mack called his best game as a Musketeer.

"My guards put me in great position," Frease said. "I wouldn't have been able to score if it wasn't for those guys putting me in good positions and finding me at the right time. It made my job pretty easy. All I had to do was turn and finish."

Lehigh center Gabe Knutson, who gave up three inches and 55 pounds to Frease, said he tried the best he could to defend Xavier's burly big man.

"I didn't do as good of a job as I could have defending him, but he's a tremendous player and he had a tremendous night," Knutson said.

Lehigh's shooting, on the other hand, wasn't so tremendous ? particularly in the second half with two separate stretches in which the team didn't make a basket for more than 6 minutes.

The Mountain Hawks shot 5 of 34 (14.7 percent) from the field in the second half.

The Musketeers held C.J. McCollum, the nation's fifth-leading scorer, to 14 points on 5-of-22 shooting and overcame a 15-point first-half deficit. He came in averaging 21.9 points per game and scored 30 in the win over Duke.

"I just wasn't making shots," McCollum said. "I just missed some shots tonight, and offense is going to come and go. We still have to get stops on defense, and we didn't do that tonight."

Mackey McKnight had 20 points for Lehigh (27-7), which tied a Patriot League record for wins in a season.

The Musketeers won despite playing most of the game without their third-leading scorer, Dezmine Wells. He injured his right toe in the first half and did not return.

Mack said he will be reevaluated this week but is hopeful he can play against Baylor.

The Mountain Hawks started strong, opening a 35-20 lead behind 53 percent shooting and 14 first-half points from McKnight. But after McCollum picked up his second foul Xavier clawed back to cut the lead to 37-33 at halftime behind a 3-point buzzer-beater by Holloway.

The Mountain Hawks went more than 7 minutes without a field goal to start the second half ? missing their first 10 shots from the field ? and the Musketeers took advantage by going on a 14-3 spurt to take a 47-40 lead.

The Mountain Hawks fought back again, however, tying the game at 52. That's when Xavier took over for good, closing with an 18-6 run.

Holloway, who had to change his jersey number in the second half from 52 to 24 after getting blood on it, led the charge.

He hit a 3-pointer with 6:58 remaining to give the Musketeers a 55-52 lead they never relinquished.

He scored 15 of his 21 points in the second half. That came two nights after he scored 17 of his 25 after halftime in a win over Notre Dame.

Holloway said getting back to the round of 16 showed Xavier's resolve.

"Coach Mack was talking to us about how everyone's taking shots at us around the country," Holloway said. "After going through so much, we're still standing today in the last 16 teams. And it showed. It just shows the character."
